Choosing a Frisco realtor

How to choose a Frisco realtor.

Texas changed the rules on January 1, 2026. Here is what a buyer agreement must say, what to ask before you sign one, and how to tell an agent who knows Frisco from one who knows the script.

What changed

The 2026 Texas buyer agreement

Since January 1, 2026, a Texas agent must have a written agreement with a residential buyer before showing that buyer any home, or before presenting an offer if no home is shown. The Texas Real Estate Commission says the agreement must list the services the agent will provide, a termination date, whether it is exclusive or non-exclusive, and the amount or rate of compensation and how it is determined.

It must also state, in conspicuous language, that broker compensation is not set by law and is fully negotiable. Read that line, then negotiate. You can also sign a short non-representation agreement just to see a home; that agreement must be non-exclusive and last no more than 14 days, and the agent cannot advise you under it.

You should also receive the Information About Brokerage Services form, which explains who the agent represents. If an agent cannot explain these documents in plain words, that tells you something.

Before you sign

Eight questions to ask

01  Are you licensed, and with which broker?

Look up any agent on the TREC license holder search. In Texas every agent works under a sponsoring broker, and that broker's name belongs on the agreement.

02  What exactly will you do for me?

The agreement must list services. Ask what happens at showings, at the option period, with the inspection, the appraisal and the repair negotiation.

03  How are you paid, and by whom?

Ask for the rate or amount and who pays it in each scenario, including new construction, where many builders pay the buyer's agent.

04  How long is the agreement, and can I end it?

Ask for a termination date that fits your search and what happens if you want out.

05  Which Frisco neighborhoods have you worked in?

Frisco spans Collin and Denton counties, several school districts and many MUD and PID areas. Ask how taxes and school zones differ on the streets you are considering.

06  How do you handle new construction?

Builders often require your agent at the first visit. Ask how the agent compares builder incentives and the builder's lender against an outside loan.

07  What do you see in an inspection that others miss?

Experience with construction changes the repair conversation. Ask for an example of a repair credit or price adjustment they negotiated.

08  How fast do you respond, and in what language?

Ask about same-day response and whether they work in Spanish if your family needs it.

Red flags

Walk away if

No written agreement

Since 2026 an agent cannot legally show you a home without one.

Commission presented as fixed

Texas law requires the agreement to say compensation is fully negotiable.

Pressure to sign a long exclusive term

You choose the term. Short terms are normal while you get to know an agent.

Vague answers on taxes and MUDs

In Frisco two homes at the same price can carry very different tax bills.

No plan for inspection and appraisal

That is where most deals are won or lost after the offer.

FAQ

Common questions

Do I have to sign a buyer agreement in Texas?
Yes, before an agent shows you a residential home, as of January 1, 2026. A short non-representation agreement is allowed just to show property, but under it the agent cannot advise you.
Is realtor commission set by law in Texas?
No. The buyer agreement must state that broker compensation is not set by law and is fully negotiable.
Does the builder pay my agent on new construction?
Many builders pay the buyer's agent from their side, but terms vary by builder and many require your agent to register you at your first visit. Ask before you go.
